Welcome to MindConstellation™.

These Terms of Use govern your access to and use of MindConstellation™, including its website, natal-chart calculation tools, accounts, interfaces, content, reports, assessments, educational material, and other products or services that link to these Terms.

By accessing or using MindConstellation™, you agree to these Terms.

If you do not agree with these Terms, do not use MindConstellation™.

MindConstellation™ is operated by Jazzed And Motivated, PLLC, referred to in these Terms as “MindConstellation™,” “we,” “us,” or “our.”

1. What MindConstellation™ Is

MindConstellation™ is an astrology-based platform designed to calculate natal charts and provide astrology-related information, educational material, self-reflection tools, and, when available, interpretive products and reports.

MindConstellation™ may include features relating to areas such as:

• personality;
• relationships;
• cognition;
• communication;
• work and vocation;
• creativity;
• emotional patterns;
• sexuality;
• life themes;
• neurocognitive themes;
• psychological or behavioral themes; and
• other astrology-related subjects.

MindConstellation™ does not claim that astrology has been scientifically established as a method for diagnosing medical, psychiatric, psychological, neurological, developmental, or other health conditions.

2. Not Medical, Mental-Health, or Professional Advice

MindConstellation™ is not a healthcare provider.

MindConstellation™ does not provide:

• medical diagnosis;
• psychiatric diagnosis;
• psychological diagnosis;
• neurodevelopmental diagnosis;
• mental-health treatment;
• psychotherapy;
• medical treatment;
• crisis services;
• legal advice;
• financial advice; or
• other licensed professional services through ordinary platform use.

Astrology-based descriptions of cognition, attention, sensory patterns, emotional functioning, neurodivergence, mental health, relationships, or behavior are not diagnoses.

MindConstellation™ must not be used as a substitute for evaluation, diagnosis, treatment, or advice from an appropriately qualified professional.

Do not delay or discontinue professional care because of information obtained through MindConstellation™.

If you are experiencing a medical or mental-health emergency, contact appropriate emergency or crisis services.

3. Astrology and Interpretive Limitations

Astrological interpretation is inherently interpretive.

MindConstellation™ may use deterministic calculation rules, structured interpretive systems, research-informed constructs, or proprietary meaning frameworks, but this does not make astrology scientifically proven or guarantee that an interpretation will accurately describe every individual.

You are responsible for deciding what personal meaning, if any, you assign to astrology-based information.

MindConstellation™ does not guarantee:

• that every interpretation will resonate;
• that astrology predicts future events;
• that chart information determines personality or behavior;
• that a report can determine another person's intentions;
• that a relationship outcome will occur;
• or that decisions made using astrology will produce a particular result.

4. Chart Calculation

MindConstellation™ calculates natal-chart information from birth data supplied by the user.

You are responsible for the accuracy of the information you submit.

Birth time can materially affect:

• Ascendant;
• Midheaven;
• houses;
• house cusps;
• angles;
• some time-sensitive placements; and
• other chart geometry.

If birth time is unknown, MindConstellation™ may omit calculations that cannot responsibly be determined without an exact birth time.

MindConstellation™ does not guarantee that inaccurate, incomplete, approximate, or incorrectly entered birth data will produce an accurate chart.

5. Charts for Other People

You may use MindConstellation™ to calculate a natal chart for another person where you have permission or other appropriate authority to provide their birth information.

You are responsible for determining whether you are authorized to submit another person's information.

The person whose birth data appears in a natal chart is the chart subject.

The chart subject is not necessarily:

• the website visitor;
• account holder;
• purchaser;
• subscriber;
• or research participant.

A chart subject's birth date must not automatically be treated as the age of the MindConstellation™ user.

6. Age Requirements

MindConstellation™ is a general-audience service and is not specifically directed to children under 13.

Anonymous natal-chart calculation does not use an age gate.

A chart subject may be any age.

MindConstellation™ accounts are intended for users age 13 and older.

The age of a chart subject does not determine the eligibility of the person operating the website or account.

Human-participant research conducted by MindConstellation™ is restricted to individuals age 18 and older and is governed separately from ordinary product use.

7. Accounts

Some MindConstellation™ features may require an account.

When creating or using an account, you agree to:

• provide information that is accurate to the best of your knowledge;
• maintain the security of your credentials;
• not share authentication credentials in a manner that compromises account security;
• promptly notify MindConstellation™ if you believe your account has been accessed without authorization; and
• use the account only in accordance with these Terms.

You are responsible for activity occurring through your account to the extent permitted by applicable law.

MindConstellation™ may suspend or restrict an account when reasonably necessary to address:

• security concerns;
• suspected fraud;
• abusive behavior;
• material violations of these Terms;
• attempts to interfere with the service;
• or unlawful activity.

8. Privacy

Your use of MindConstellation™ is also governed by the MindConstellation™ Privacy Policy.

The Privacy Policy explains how personal information, including birth information, account information, analytics, and other data, is collected and handled.

Acceptance of these Terms does NOT constitute consent to participate in MindConstellation™ research.

9. Intellectual Property

MindConstellation™ and its licensors retain all rights, title, and interest in the MindConstellation™ platform and protected materials, including where applicable:

• the MindConstellation™ name and branding;
• logos and visual identity;
• website design;
• chart interface design;
• natal-wheel interface;
• report layouts;
• report architecture;
• written content;
• interpretations;
• report text;
• educational content;
• product taxonomy;
• naming systems;
• domain architecture;
• proprietary categorization systems;
• semantic systems;
• doctrine systems;
• meaning libraries;
• scoring systems;
• detection systems;
• classification systems;
• configuration systems;
• interpretation frameworks;
• report-generation architecture;
• structured datasets created by MindConstellation™;
• research compilations;
• proprietary selection and arrangement of information;
• software;
• source code;
• object registries;
• configuration registries;
• database structures;
• original graphics;
• and other original materials.

Nothing in these Terms transfers ownership of MindConstellation™ intellectual property to you.

10. Limited Personal-Use Permission

Subject to these Terms, MindConstellation™ grants you a limited, revocable, non-exclusive, non-transferable permission to access and use the service and lawfully obtained outputs for your own personal use.

You may:

• view your chart;
• save available chart information;
• download or retain lawfully provided personal reports where the product permits;
• discuss your own results;
• and make ordinary personal use of purchased or freely provided outputs.

This permission does not include commercial exploitation or reproduction of MindConstellation™'s proprietary system.

11. Prohibited Uses

Unless MindConstellation™ provides express written permission, you may not:

• scrape the website or service;
• systematically extract content;
• use bots, crawlers, spiders, automated scripts, or harvesting tools to collect MindConstellation™ content or outputs;
• download content in bulk;
• create or maintain an unauthorized mirror of the service;
• reproduce substantial portions of MindConstellation™ content;
• republish reports commercially;
• resell MindConstellation™ reports or outputs;
• remove copyright, trademark, attribution, or proprietary notices;
• impersonate MindConstellation™;
• falsely claim affiliation with MindConstellation™;
• interfere with or disrupt the service;
• attempt unauthorized access to accounts, servers, administrative tools, APIs, or data;
• circumvent technical limits or security controls;
• probe or exploit vulnerabilities except through an authorized security process;
• reverse engineer proprietary report-generation logic;
• reverse engineer proprietary scoring or detection methods;
• reconstruct MindConstellation™ doctrine or semantic systems through systematic output collection;
• derive competing datasets through automated or systematic extraction;
• build a competing product by systematically copying MindConstellation™ outputs, classifications, structures, taxonomies, or methodologies;
• use MindConstellation™ content or outputs as a substitute corpus for reproducing the proprietary MindConstellation™ system;
• use systematic MindConstellation™ outputs to train, fine-tune, benchmark, evaluate, or construct a competing commercial model or interpretation system without written permission;
• or use the service for unlawful purposes.

Ordinary personal discussion, commentary, criticism, reviews, quotation, or other uses permitted by applicable law are not prohibited by this section.

Nothing in these Terms is intended to restrict rights that cannot lawfully be waived or prohibited.

12. No Reverse Engineering of Proprietary Methodology

MindConstellation™ invests substantial resources in developing its astrology doctrine, interpretation architecture, semantic frameworks, classification systems, research compilations, scoring methods, product structure, and report-generation methodology.

You may not systematically analyze, collect, compare, reproduce, or manipulate MindConstellation™ outputs for the purpose of reconstructing these proprietary systems for commercial exploitation or development of a competing service.

This restriction does not prohibit legitimate independent research, commentary, criticism, or legally protected analysis that does not misuse access to the service or violate applicable law.

13. User Content and Information You Submit

You retain ownership of information and original content that you lawfully submit to MindConstellation™.

You grant MindConstellation™ the limited rights reasonably necessary to process submitted information for the purposes described in the Privacy Policy and to provide the service you requested.

Submitting birth information does not transfer ownership of that information to MindConstellation™.

You represent that you have the right or appropriate authority to submit information you provide about another person.

14. Research Participation

Ordinary MindConstellation™ use does not enroll you in research.

Research participation is separate from:

• chart generation;
• account creation;
• accepting these Terms;
• accepting the Privacy Policy;
• purchases;
• saved charts;
• waitlists;
• and marketing subscriptions.

MindConstellation™ human-participant research is limited to participants age 18 and older under the current research policy.

Where research is offered, eligible participants must be provided a separate research participation notice and consent process.

Research may involve areas including:

• neurodivergence;
• ADHD;
• autism;
• executive functioning;
• attention;
• cognition;
• sensory processing;
• mental health;
• psychological experiences;
• emotional functioning;
• behavioral patterns;
• or other human-trait research.

A chart belonging to a person under 18 may not be treated as research participation merely because that chart was generated, saved, or associated with another user's account.

15. Assessments and Screening-Style Features

MindConstellation™ may offer questionnaires, assessments, scoring tools, or pattern-detection features.

Unless expressly stated otherwise, these tools are intended for informational, educational, self-reflective, or research purposes.

They are not clinical diagnostic instruments and must not be treated as establishing:

• ADHD;
• autism;
• a psychiatric disorder;
• a neurological condition;
• a learning disorder;
• a personality disorder;
• a medical condition;
• or any other diagnosis.

16. Reports and Digital Products

MindConstellation™ may offer free or paid reports and digital products.

Availability may change over time.

A report may include:

• calculated chart information;
• astrology interpretations;
• structured synthesis;
• educational content;
• or other product-specific material.

The scope and contents of a report may differ by product.

Purchasing one product does not entitle the purchaser to every MindConstellation™ product, report, feature, future update, or service.

Paid reports are not currently available.

17. Payments

If paid products become available, payments may be processed through an external payment processor.

MindConstellation™ does not intentionally receive raw payment-card numbers through its ordinary application code when payment is handled through a hosted payment processor.

Additional checkout, billing, refund, or purchase terms may be presented at the point of sale.

Where product-specific purchase terms conflict with these general Terms regarding that transaction, the more specific purchase terms may control to the extent permitted by law.

18. Refunds and Digital Delivery

Refund and digital-product purchase terms will be disclosed at checkout when paid MindConstellation™ products become available.

19. Third-Party Services

MindConstellation™ may rely on third-party services for functions such as:

• hosting;
• infrastructure;
• fonts or content delivery;
• payment processing;
• communications;
• or other technical services.

Third-party services may be governed by their own terms and privacy practices.

MindConstellation™ is not responsible for third-party services outside our reasonable control, subject to applicable law.

20. Links to Other Websites

MindConstellation™ may contain links to third-party websites or resources.

A link does not necessarily mean MindConstellation™ endorses or controls that third party.

Your use of a third-party site is subject to that site's own terms and policies.

21. Availability and Changes to the Service

MindConstellation™ is actively developing.

Features may be:

• added;
• removed;
• changed;
• tested;
• suspended;
• or discontinued.

We do not guarantee that every feature will always remain available or unchanged.

We may perform maintenance or updates that temporarily affect availability.

Where required by law, we will provide appropriate notice concerning material changes affecting contractual or privacy rights.

22. Beta, Preview, and Coming-Soon Features

Some MindConstellation™ features may be labeled:

• beta;
• preview;
• experimental;
• prototype;
• coming soon;
• or similar language.

Such features may be incomplete or subject to change.

A “coming soon” description is not a guarantee that a feature will launch by a particular date.

23. Calculation and Software Errors

MindConstellation™ takes reasonable steps to maintain calculation and software integrity, but no software system is guaranteed to be error-free.

Errors may arise from:

• incorrect user input;
• incomplete source data;
• software defects;
• historical location or time-zone complexity;
• technical outages;
• ephemeris or data-source issues;
• browser or device problems;
• or other causes.

If you believe MindConstellation™ has produced a calculation error, please contact us through the available support channel.

24. No Guarantee of Outcomes

MindConstellation™ does not guarantee outcomes concerning:

• relationships;
• compatibility;
• employment;
• career;
• finances;
• health;
• mental health;
• sexuality;
• pregnancy;
• family matters;
• education;
• legal matters;
• business decisions;
• investments;
• or future events.

You remain responsible for your own decisions.

25. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MINDCONSTELLATION AND ITS SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES THAT ARE NOT EXPRESSLY PROVIDED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

• THE SERVICE WILL ALWAYS BE AVAILABLE;
• THE SERVICE WILL BE ERROR-FREE;
• EVERY INTERPRETATION WILL BE ACCURATE;
• EVERY USER WILL IDENTIFY WITH AN INTERPRETATION;
• OR USE OF THE SERVICE WILL PRODUCE A PARTICULAR RESULT.

Nothing in this section excludes warranties or protections that cannot lawfully be excluded.

26. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MINDCONSTELLATION AND ITS OWNERS, OPERATORS, EMPLOYEES, CONTRACTORS, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO USE OF THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MINDCONSTELLATION WILL NOT BE RESPONSIBLE FOR LOSSES RESULTING FROM RELIANCE ON ASTROLOGICAL INTERPRETATION IN PLACE OF QUALIFIED PROFESSIONAL ADVICE.

Nothing in these Terms limits liability where applicable law prohibits such a limitation.

27. Indemnification

To the extent permitted by applicable law, you agree to be responsible for claims, losses, or expenses arising from:

• your unlawful use of MindConstellation™;
• your material violation of these Terms;
• your violation of another person's rights;
• or information you knowingly submit without appropriate authority.

28. Suspension and Termination

MindConstellation™ may suspend or terminate access where reasonably necessary because of:

• material violation of these Terms;
• unlawful conduct;
• fraud;
• security threats;
• abusive automated activity;
• interference with the service;
• or attempts to misuse MindConstellation™ intellectual property or systems.

Where appropriate and feasible, MindConstellation™ may provide notice before termination.

You may stop using MindConstellation™ at any time.

29. Changes to These Terms

MindConstellation™ may update these Terms as the service develops.

When material changes are made, MindConstellation™ will provide notice as appropriate.

Where applicable law requires additional notice or affirmative agreement to materially revised Terms, MindConstellation™ will provide it.

Continued use must not be treated as consent where applicable law requires a different form of agreement.

30. Governing Law

These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law principles, except where applicable law requires otherwise.

31. Dispute Resolution / Venue

Subject to applicable law, disputes arising from these Terms that are brought in court will be brought in an appropriate state or federal court located in Washington.

32. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect to the extent permitted by law.

The unenforceable provision should be interpreted or limited only to the extent necessary to make it enforceable where permitted.

33. No Waiver

Failure by MindConstellation™ to enforce a provision of these Terms does not automatically waive the right to enforce it later.

34. Entire Agreement

These Terms, together with the Privacy Policy and any additional terms expressly presented for a particular product or transaction, form the agreement governing your use of MindConstellation™ regarding the subjects they address.

Product-specific terms may supplement these Terms.
